These Terms of Service ("Terms") are a legal agreement between you and FarmConnect LLC ("FarmConnect," "we," "us," or "our") governing your use of the FarmConnect mobile app and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read this carefully. FarmConnect is a discovery platform, not a store. We do not grow, make, inspect, sell, deliver, or handle payment for any product, and we are not a party to any transaction between a shopper and a producer. You reserve items and pay the producer directly, in person.

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into these Terms.

2. What FarmConnect is (and isn't)

FarmConnect helps shoppers discover local farmers, ranchers, food makers, farm stands, shops, farmers markets, and food events, and helps producers list what they offer. FarmConnect provides listings and introductions only. All arrangements — availability, quality, price, pickup, and payment — are strictly between the shopper and the producer. FarmConnect is not the seller, buyer, agent, host, or organizer, and does not take a commission on sales.

3. No inspection, endorsement, or food-safety guarantee

Products listed on FarmConnect are offered directly by independent producers. FarmConnect does not make, inspect, test, endorse, or verify any product, producer, or listing. Products have not been evaluated or approved by FarmConnect or, unless a producer states otherwise, by the U.S. Food and Drug Administration or any other agency.

Producers are responsible for complying with all laws that apply to them, including obtaining any required licenses, permits, registrations, and food-safety credentials, and for labeling their products as their state requires.
Shoppers use their own judgment. Ask producers about their practices, follow safe food-handling, and be aware that some items (for example, raw/unpasteurized dairy or raw sprouts) carry higher risk. Consume at your own discretion.

4. Producer accounts and responsibilities

If you create a producer account, you agree to:

Provide accurate information and keep your account secure;
Certify that your products are legal to sell and that you hold all licenses/registrations your state requires, and label them accordingly;
Only list items permitted under our prohibited-items policy, and never list unsafe, illegal, recalled, or misrepresented products;
Honor the listings and reservations you accept, and deal fairly and honestly with shoppers;
Accept full responsibility for your products and your compliance. FarmConnect does not verify your certifications.

5. User content

You retain ownership of the content you submit (such as listings, photos, and descriptions). You grant FarmConnect a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Service to operate and promote it. You represent that you have the rights to the content you post and that it does not infringe others' rights or violate any law.

We may, but are not obligated to, review, moderate, or remove content. Users can report listings or producers, and we may remove content or suspend accounts that violate these Terms.

6. Acceptable use

You agree not to misuse the Service, including: posting false, misleading, illegal, or harmful content; harassing others; infringing intellectual property; attempting to interfere with or gain unauthorized access to the Service; or using it for any unlawful purpose.

7. Reservations, pickups, and payment

Reservations are requests to a producer, not confirmed purchases, and are fulfilled at the producer's discretion. All payment happens directly between you and the producer, in person. FarmConnect never handles, holds, or processes money and is not responsible for any transaction, no-show, refund, dispute, or the safety, quality, or legality of any product.

8. Markets and events ("Gatherings")

Listings for farmers markets and events are provided for discovery and may come from public sources or organizers. Details can change — confirm with the organizer before you go. FarmConnect is not the host or organizer and is not responsible for any event or for third-party information.

9. Intellectual property

The FarmConnect name, logo, and app (excluding user content) are owned by FarmConnect LLC and protected by law. We grant you a limited, revocable, non-transferable, non-exclusive license to use the app on devices you own or control, solely for your personal, lawful use of the Service. You may not copy, modify, reverse-engineer, or resell the app.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FARMCONNECT DOES NOT WARRANT THAT LISTINGS, PRODUCERS, PRODUCTS, OR INFORMATION ARE ACCURATE, SAFE, LEGAL, OR AVAILABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FARMCONNECT AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY PRODUCT, PRODUCER, TRANSACTION, PICKUP, OR EVENT; OR (C) ANY CONTENT PROVIDED BY USERS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold FarmConnect harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your products or transactions, or your violation of these Terms or any law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.

14. App stores (Apple and Google)

You obtained the app from the Apple App Store or Google Play. You acknowledge that:

These Terms are between you and FarmConnect only, not with Apple or Google, and Apple and Google are not responsible for the app or its content.
FarmConnect — not Apple or Google — is solely responsible for the app, its support and maintenance, and any product warranties or claims.
You will comply with all applicable third-party terms (for example, your wireless data plan) and U.S. export and sanctions laws.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Google is likewise a beneficiary where applicable.
Apple's standard Licensed Application End User License Agreement also applies to the extent it is not superseded by these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction, unless a binding arbitration provision is added and provided to you.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Your continued use of the Service after changes take effect means you accept the updated Terms.
